(e) ANTITRUST EXEMPTION.—

(1) IN
GENERAL.—Except
as provided in sec-
3
tion 108(e), it shall not be considered a violation of
4
any provision of antitrust laws for 2 or more private
5
entities to exchange or provide a cyber threat indi-
6
cator, or assistance relating to the prevention, inves-
7
tigation, or mitigation of a cybersecurity threat, for
8
cybersecurity purposes under this title.

(2) APPLICABILITY.—Paragraph (1) shall apply
10
only to information that is exchanged or assistance
11
provided in order to assist with—
12
(A) facilitating the prevention, investiga-
13
tion, or mitigation of a cybersecurity threat to
14
an information system or information that is
15
stored on, processed by, or transiting an infor-
16
mation system; or
17
(B) communicating or disclosing a cyber
18
threat indicator to help prevent, investigate, or
19
mitigate the effect of a cybersecurity threat to
20
an information system or information that is
21
stored on, processed by, or transiting an infor-
22
mation system.

(f) NO RIGHT
OR
BENEFIT.—The sharing of a cyber
24 threat indicator with an entity under this title shall not
