Initial Pre-draft of the report of the OEWG on developments
in the field of information and telecommunications
in the context of international security
Comments by Thailand
1. Thailand appreciates the Chair for the preparation and circulation of the
initial pre-draft report of the OEWG which we deem to be factual,
comprehensive, and well balanced.
2. In Paragraph 24 of section C. International Law, we would suggest the
usage of the term “customary international law” in place of “international
customary law” since the former is the commonly used term when
referring to international obligations arising from established international
practices, as opposed to obligations arising from formal written
conventions and treaties.
3. As per Paragraph 68 of Section H. Conclusions and Recommendations,
Thailand welcomes the invitation for Member States to continue
discussion on the applicability of international law in the context of State
use of ICTs, through the Secretary-General and UNIDIR, and support the
request for the International Law Commission to be charged with
undertaking a study in this regard. We see merit in streamlining related
initiatives where applicable in order avoid duplication.
