certificate of exemption, in the prescribed form in which his
name, and the scope, period and conditions of the exemption
are specified.
(4) A certificate of exemption granted pursuant to
subsection (3) shall be published in the Gazerte and shall
become valid upon the date of such publication. No such
publication shall be required in the case of equipment
imported, manufactured, assembled, possessed, operated,
or purchased by a law enforcement or security agency
operating for or on behalf of the Government and the
purpose of which shall be to carry out lawful interceptions
under this Act.
(5) Acertificate of exemption may at any time in like
manner be amended or withdrawn by the Council.
(6)
Penalty for
contravention
of section 24.
A certificate of exemption lapses upon:
(a)
termination of the period for which it was
granted; or
(b)
withdrawal pursuant to subsection (5).
26. (1) A person who contravenes section 24 commits an
offence and, on conviction on indictment, is liable to:
(a)
a fine of not less than twenty five thousand
dollars and not exceeding fifty thousand
dollars or to a term of imprisonment not
exceeding three years in the first instance;
(b)
a fine of not less than fifty thousand dollars and
not exceeding one hundred thousand dollars or
to a term of imprisonment not exceeding five
years in the second instance; and
(c)
a fine of one hundred thousand dollars and a
term of imprisonment not exceeding five
years in the subsequent instances.
