63 1 2 ‘‘(1) CONDITIONS.—A private entity described in subsection (c)(2) may not— 3 ‘‘(A) disclose any network traffic transiting 4 or traveling to or from an agency information 5 system to any entity without the consent of the 6 Department or the agency that disclosed the in- 7 formation under subsection (c)(1); or 8 ‘‘(B) use any network traffic transiting or 9 traveling to or from an agency information sys- 10 tem to which the private entity gains access in 11 accordance with this section for any purpose 12 other than to protect agency information and 13 agency information systems against cybersecu- 14 rity risks or to administer a contract or other 15 agreement entered into pursuant to subsection 16 (c)(2) or as part of another contract with the 17 Secretary. 18 ‘‘(2) LIMITATION ON LIABILITY.—No cause of 19 action shall lie in any court against a private entity 20 for assistance provided to the Secretary in accord- 21 ance with this section and any contract or agree- 22 ment entered into pursuant to subsection (c)(2). 23 ‘‘(3) RULE OF CONSTRUCTION.—Nothing in 24 paragraph (2) shall be construed to authorize an 25 Internet service provider to break a user agreement † S 754 ES
