PART2 COMPUTER OFFENCES PART2 COMPUTER OFFENCES 3 qd) Illegal access For the purposes of this section, critical infrastructure means vital computer systems, physical facilities, processes, supply chains, information technologies, communication networks, devices, public utilities and essential services, (2) A person who intentionally and without lawful excuse, accesses the whole or part of a computer system by infringing a security measure, commits an offence and is liable on conviction: (a) _ in the case of an individual- to a fine not exceeding VT2,00 0,000 or to a term of imprisonment not exceeding 5 years, or both; or (b) _ in the case of'a body corporate-to a fine not exceed ing VT4,000,000. () A person who intentionally and without lawful excuse, accesse s the whole or part of a critical infrastructure, commits an offence and is liable on conviction: (a) (b) _ (4) in the case of-an individual- to a fine not exceeding VT2,00 0,000 or fo a term of imprisonment not exceeding 5 years, or both; or in the case of a body corporate- to a fine not exceeding VT4,000,000. A person does not commit an offence under thissection if that person: (a) _ .(b) 4 (1) : is entitled to have access to the program or data; or has consent to have access to the program or data, Illegal interception A person must not intentionally and without lawful excuse, intercept by any technical means: (a) any non-public transmission of computer data to, from or within a computer system; or (b) _ electromagnetic emission from a computer system carrying such computer data.
