PRELIMINARY
makes available includes, but not limited to, describing how to obtain access, or
describing methods that are likely to facilitate access;
Minister means the Minister responsible for Information Communication and
Technology;
Mutual Assistance in Criminal Matters Act means the Mutual Assistance in
Criminal Matters Act [CAP 285];
police officer means any member of the Vanuatu Police Force established by the
Police Act [CAP 105];
program means data representing instructions or statements that, when executed
in a computer system, causes the computer system to perform a function and make
references to a program including references to part of a program;
real time means when information is being generated or transmitted;
serious offence has the same meaning as in the Proceeds of Crime Act [CAP
284];
service provider means:
{a)
a public or private entity that provides to users of its services the ability to
communicate by means of a computer system; and
(b)
any other entity that processes or stores computer data on behalf of that
entity or the users of that entity; and
)
a service provider under the Telécommunications, Radiocommunications
and Broadcasting Regulation Act No. 30 of 2009;
specified offence means an offence against a law of Vanuatu for which the
maximum penalty is imprisonment for a term not exceeding 4 years;
subscriber data:
(a)
means any data held by a service provider (whether in the form of
computer data or any other form) in relation to a person using or renting its
services (a “subscriber”) by which the following can be established:

the type of service used, the technical provisions taken in relation
to the service and the period of service; and
