Summary

Purpose and Objectives

Lays the foundations and inform the development of instititional and legal franework for data protection and privacy to safeguard personal data and associated rights of individuals, and in partiular the right to privacy.
Establishes internationally recognised best practices in data protection and privacy law, including fair, transparent and lawful processing of personal data, exitence of explicit, specified and legitimate purpose for processing personal data, data protection and privacy by design and default among others.
Ensures appropriate safeguards for the processing of speical categories of personal data, especially personal data about children and other vulnerable grpups of individuals.
Establishes individuals’rights concerning their personal data.
Provides a framework for assessmnent of the existence of appropriate level of protection for cross-border trasfer of personal data.
Proposes the requirement for the establishment of an independent and impartial National Supervisory Authority that will be mandated to ovsersee, monitor and enforce complaince and safeguarding of persoanl data and privacy rights of individuals.

Scope of the Policy

The Policy is applicable to processing of personal data within the jurisdiction of The Gambia – in the private and public sectors, whether by automated or non-automated means and irrespective of the nationality or place of residence of the data subhject.
The Policy is not applicable to the processing of personal data made for personal or household purposes as well as data about deceased persons.
