(b) May, in exceptional circumstances, take into

account new information submitted by a party to the

appeal.

(8) The appeals panel may stay the operation of the
decision while considering the application.
(9) The appeals panel shall:

(a) Affirm the decision under review;

(b) Vary the decision under review;

(c) Set aside the decision under review and make
11
their own decision, which shall be treated as a decision
12
of the Authority; or
13
(d) Refer the matter back to the Authority for
14
reconsideration in such respects as the panel shall
15
specify and the Authority shall comply with any such
16
direction.

(10) The appeals panel shall give a copy of its
18
decision and the reasons for the decision to each person
19
affected by the decision and the Authority.

(11) The Authority shall publish a decision of the
appeals panel given to it under subsection (9).
(12) The costs of the appeals panel in conducting the
23
review shall be borne by the person making the

application for review.
