Act on the Protection of Personal Data (transposing into the Portuguese legal
system Directive 95/46/EC of the European Parliament and of the Council of
24 October 1995 on the protection of individuals with regard to the
processing of personal data and on the free movement of such data).
Under article 161 (c), article 165 (1) (b) and (c) and article 166 (3) of the Constitution, the
Assembleia da Rep�blica hereby decrees the following, which shall have the force of a
general Act of the Republic:
This Act transposes into the internal legal system Directive 95/46/EC of the European
Parliament and of the Council of 24 October 1995 on the protection of individuals with
regard to the processing of personal data and on the free movement of such data.
The processing of personal data shall be carried out transparently and in strict respect for
privacy and for other fundamental rights, freedoms and guarantees.
