Version as at 6 November 2021 (2) Crimes Act 1961 Part 1 s 10B (a) nothing in this section shall limit or affect the power or authority of the House of Representatives to punish for contempt: (b) nothing in this section shall limit or affect the jurisdiction or powers of the Court Martial, or of any officer in any of the New Zealand forces. The jurisdiction, authority, or power of a court to punish for contempt is sub‐ ject to the Contempt of Court Act 2019. Section 9(2): inserted, on 26 August 2020, by section 29 of the Contempt of Court Act 2019 (2019 No 44). 10 Offence under more than 1 enactment (1) Where an act or omission constitutes an offence under this Act and under any other Act, the offender may be prosecuted and punished either under this Act or under that other Act. (2) Where an act or omission constitutes an offence under 2 or more Acts other than this Act, the offender may be prosecuted and punished under any one of those Acts. (3) Where an act or omission constitutes an offence under 2 or more provisions of this Act or of any other Act, the offender may be prosecuted and punished under any one of those provisions. (4) No one is liable to be punished twice in respect of the same offence. Compare: 1908 No 32 s 6; 1924 No 11 s 25(i) Section 10(4): replaced, on 1 July 2013, by section 6 of the Crimes Amendment Act (No 4) 2011 (2011 No 85). 10A Criminal enactments not to have retrospective effect Notwithstanding any other enactment or rule of law to the contrary, no person shall be liable in any criminal proceedings in respect of an act or omission by him or her if, at the time of the act or omission, the act or omission by him or her did not constitute an offence.
