55. (1) The Prime Minister may by order published in the
Gazette exempt from any of the provisions of this Act, any
electronic communications network and, or service, or any
radiocommunications apparatus exclusively used by the State for
activities concerning public security, defence, State security,
including the economic well-being of the State in the case of
activities pertaining to State security matters, and the activities of
the State in the area of criminal law:
to:
Provided that no exemptions shall be granted with respect
(a) the requirement of having an explicit authorisation
issued by the Authority for the rights of use for radio
spectrum; or
(b) the installation or use of radiocommunications
apparatus capable of causing deliberate interference,
as provided for in article 31A.
(2) The Prime Minister shall, in making an order under this
article, first consult with the Authority, and may after having done
so, impose any such conditions as he may consider appropriate in
the circumstances.
