Act 9 Penal Code Act 2008 “Essential service” means— (a) any service relating to the generation, supply or distribution of electricity; (b) any fire brigade or fire service; (c) any health, hospital or ambulance service; (d) any service relating to the production, supply, delivery or distribution of fuel; (e) any service relating to the supply or distribution of water; (f) any communications service; (g) any transport service; or (h) any other service or occupation whose interruption would endanger the life, health or safety of the whole or a part of the population and which the Minister may declare by notice in a statutory instrument to be an essential service; “Fraudulently” or “with intent to defraud” means a state of mind where an act is committed by a person with the intent to deceive, and by means of such deceit, to obtain some advantage for himself or another or to cause loss to any other person; “Good faith” means a state of mind where an act is committed or believed to be done honestly, with due care and attention, and without malice; “Government” means the Government of Southern Sudan, State and the Local Government; “Guardian” or “lawful guardian” means any person lawfully entrusted with care or custody of a minor or other person authorised to consent to the taking of such a minor out of the custody; “Harbour” means the act of affording lodging, shelter, or refuge to another person who has committed or intends to commit an offence or who is seeking to evade arrest; “Constitution” or “ICSS” means the Interim Constitution of Southern Sudan, 2005; “Illegal” means something which is prohibited by this Act or other applicable law; 21
