§ 5. 'Processor' shall mean any natural person, legal person, factual association or public
authority that processes personal data on behalf of the controller, except for the persons who,
under the direct authority of the controller or the processor, are authorised to process the
data.
§ 6. 'Third party' shall mean any natural person, legal person, factual association or public
authority other than the data subject, the controller, the processor and the persons who, under
the direct authority of the controller or the processor, are authorised to process the data.
§ 7. 'Recipient' shall mean any natural person, legal person, factual association or public
authority to which data are disclosed, whether a third party or not; however, administrative or
judicial authorities to which data may be disclosed in the context of a particular inquiry shall
not be regarded as recipients;
§ 8. 'Consent of the data subject' shall mean any freely given, specific and informed indication
of his wishes by which the data subject signifies his agreement to personal data relating to
him being processed.
Article 2
Any natural person shall be entitled to the protection of his fundamental rights and freedoms,
in particular the protection of his privacy, with regard to the processing of personal data
relating to him.
Article 3
§ 1. This law shall apply to the processing of personal data wholly or partly by automatic
means, as well as to the processing otherwise than by automatic means of personal data that
form part of or are intended to form part of a filing system.
§ 2. This law shall not apply to the processing of personal data carried out by a natural person
in the course of purely personal or household activities.
§ 3. a) The Articles 6, 7 and 8 shall not apply to the processing of personal data carried out
solely for journalistic purposes or the purpose of artistic or literary expression, if the
processing relates to personal data that have been apparently made public by the data
subject or that are closely related to the public character of the data subject or of the fact in
which the data subject is involved.
b) Article 9 § 1 shall not apply to the processing of personal data carried out solely for
journalistic purposes or the purpose of artistic or literary expression, if the application thereof
would interfere with the collection of data from the data subject.
Article 9 § 2 shall not apply to the processing of personal data carried out solely for
journalistic purposes or the purpose of artistic or literary expression, if the application thereof
would have one or more of the following effects:

the application would interfere with the collection of the data;
the application would interfere with an intended publication;
the application would give indications on the sources of information.
c) The Articles 10 and 12 shall not apply to the processing of personal data carried out solely
for journalistic purposes or the purpose of artistic or literary expression, as far as the
application thereof would interfere with an intended publication or give indications on the
sources of information.
