142. Remedies for non-compliance
(1) The Commission or a person may seek an interim or interlocutory injunction against any conduct
prohibited in this Chapter.
(2) A person shall obtain a certificate from the Commission for leave to proceed to the court for
enforcement of the provisions of this Chapter except in the case of an injunction.
143. Penalty for offence.
A person who contravenes any prohibition under this Chapter commits an offence and shall, on
conviction, be liable to a fine not exceeding five hundred thousand ringgit or to imprisonment for a
term not exceeding five years or to both and shall also be liable to a further fine of one thousand
ringgit for every day or part of a day during which the offence is continued after conviction.
144. Minister may make rules.
(1) Subject to subsection (2), the Minister may make rules, to be published in the Gazette, in respect
of agreements between licensees, under this Act, and foreign network facilities providers and/or
network service providers.
(2) The Minister shall only make the rules, under subsection (1), which are intended to prevent or
mitigate—
(a) any conduct by foreign network facilities providers and/or network service providers which
will, or is likely to lead to, a substantial lessening of competition in a communications market;
or
(b) the misuse of market power in a communications market.
Chapter 3 - Access To Services
145. Facilities and services which may be included in the access list.
(1) The list of facilities and services which may be included in the access list, as determined by the
Commission under this Chapter, are—
(a) network facilities;
(b) network services; and
(c) other facilities and/or services which facilitate the provision of network services or
applications services, including content applications services.
(2) The facilities or services listed in paragraph (1)(c) do not have to be owned or provided by the
licensees under this Act.
146. Determination of facilities and services by the Commission.
Subject to subsection 147(2), the Commission may determine that—
