For getting a radio apparatus licence, allocation of a radio frequency or
technical acceptance certificate, an application shall be submitted to the Commission;
and within 7 (seven) days of the receipt of such application, the Commission shall send
it, with comments, if any, to the Committee which shall, within the next 30 days, make
such inquiry on the matter as it considers necessary and present the application with its
comments and recommendations to the Commission.
(9)
The Commission shall, after consideration of the comments and
recommendations of the Committee on the concerned application, take decision on the
issuance of a licence for radio apparatus or, as the case may be, a technical acceptance
certificate or allocation of radio frequency; and shall in all cases determine the
conditions applicable thereto after consideration of the Committee’s recommendation.
57.
Technical Acceptance Certificate.- (1) The Commission may, by issuing notice
in at least two widely circulated national dailies published from Dhaka, or by making
regulations, specify the radio apparatus or interference causing apparatus for which
technical acceptance certificate is necessary.
(2)
When a technical acceptance certificate in relation to an apparatus is
required by a notice published, or by regulations made, under sub-section (1), no person
shall, except in accordance with such certificate, use, distribute, sell or offer for sale,
lease out or demonstrate that apparatus.
(3)
A person commits an offence if he violates sub-section (2), and for such
offence he shall be liable to imprisonment for a term not exceeding 5 (five) years or to a
fine not exceeding 5 (five) lac taka or to both.
(4)
The Commission shall, in relation to an apparatus mentioned in sub-
section (1),(a)
make regulations on the standards determined by the Spectrum
Management Committee under section 56(5)(f) or publish such
standards in at least two widely circulated national dailies; or
(b)
make regulations specifying the procedure and other matters
relating to the issuance of a technical acceptance certificate, and
renewal, suspension and cancellation thereof, and until such
regulations are made, those matters shall be determined by
administrative orders.
