(7) The Regulator shall only deny a transfer of control or
attach conditions to a transfer of control under this section if the
Regulator determines, acting reasonably, that the transfer would
have serious anti-competitive effects which would outweigh any
positive effects for telecommunications customers.
PART VII
INTERCONNECTION
32. Functions and Duties of the Regulator Regarding
Interconnection-The Regulator shall perform the following
functions and duties in relation to interconnection of
telecommunications networks:
(a)
promote adequate, efficient and cost-oriented
interconnection of telecommunications networks
and access by service providers to
telecommunications facilities of other service
providers, in order to permit interoperability of
telecommunications services that originate or
terminate in Samoa and to promote the
development of competitive telecommunications
service market;
(b)
establish an open, non-discriminatory and
commercially viable regulatory framework for
interconnection and access with a view to
minimizing regulatory and other barriers to entry
into telecommunication markets;
(c) promote interconnection arrangements, including by
facilitating negotiations between parties to reach
interconnection agreements;
(d) ensure that interconnection agreements otherwise
meet the objectives of this Act;
(e) determine which service providers are dominant
service providers in a telecommunications
market for interconnection;
(f) if considered appropriate by the Regulator, regulate
the prices for interconnection and access services
by dominant service providers in a
telecommunications market for interconnection;
