believed, that he had or has political connections or is involved in the
activities of a political party.
(4) In the absence of any fact which, according to the provisions of any of
the subparagraphs of (i), (ii), (iii) and (iv) of paragraph (d) of subsection (3)
of this Section, constitutes an impediment to the appointment of a person as
Commissioner or Deputy Commissioner, the mere fact that a person holds or
held at any time within a period of six months immediately preceding the
intended appointment, any position as public servant in the public service or
as an employee in a legal entity or a body governed by public law within the
meaning of paragraph (c) of subsection (3) of Section (5) of this Law or
serves or has served as a member of the Judicial Service of the Republic or
as an independent officer thereof from amongst those mentioned in Part VI
of the Constitution of the Republic, does not constitute in itself an
impediment to appointment under paragraph (c) of subsection (3) of this
Section.
(5) Before undertaking their respective duties, the Commissioner and the
Deputy Commissioner shall give their assurances to the President that they
shall faithfully perform their duties.
Removal
of
Commissioner
and Deputy
Commissioner.
6.(1) The Commissioner and Deputy Commissioner may only be removed
from office before the expiry of the respective period for which they were
appointed by the Council of Ministers and only on the basis of any of the
following specific grounds:
(a) owing to mental or physical incapacity or disability, or any other disease
without exception, which would render the Commissioner or the Deputy
Commissioner, as the case may be, incapable of adequately performing his
duties for the remainder of his term of office; or
