(4) If the convicted person violates the prohibition and leaves the house, on a proposal of
the competent body in accordance with the law, the court may decide that the convicted
person should serve the replaced sentence in full, within an institution for serving
imprisonment.
Chapter five
SAFETY MEASURES
Purpose of the safety measures
Article 60
The purpose of the safety measures shall be to remove situations or conditions that may
influence the offender to commit crimes in the future.
Types of safety measures
Аrticle 61
Offenders may be imposed the following safety measures:
1) compulsory psychiatric treatment and custody in a health institution;
2) compulsory psychiatric treatment in freedom; and
3) compulsory treatment of alcoholics and drug addicts;
4) medical and pharmacological treatment of offenders of sexual assault upon a child of up
to 14 years of age.
Imposing a safety measure
Article 62
(1) The court may impose one or more safety measures for the offender, when conditions
anticipated by this Code exist for their imposing.
(2) Compulsory psychiatric treatment and custody in a health institution, and compulsory
psychiatric treatment in freedom, shall be imposed independently for a mentally
incompetent offender of a crime.
(3) In the decision imposing the measures referred to in paragraph 2, the court may
temporarily prohibit the offender form performing his profession, activity or duty, or
temporarily prohibit the offender from operating a motor vehicle, which prohibitions shall
last for the whole duration of the imposed measures. The court shall submit its decision to
the competent body or legal entity where the offender is employed, to the registry court or
to the body competent for supervising the enforcement of the prohibition to operate a
motor vehicle.
