and conditions of the licence, abide by any
directive issued by the Authority for the purpose of(a)
ensuring that the capacity, quantity and
features of the system are sufficient for
providing and maintaining an efficient
information and communications system or
service;
(b)
ensuring that the system is sufficient for
and compatible with such international
information and communications services
as the Authority may specify;
(c)
making provision for the security of the
system and of any of its extension; and
(d)
ensuring the implementation of open network architecture or provisions.
(3) The Authority shall regularly review and refine
the general regime for the regulation of the
information and communications sector to ensure
its sufficiency and completeness, taking into
consideration market trends and developments.
(4) Information and communications licensees are
subject to the regulatory regime to the same extent
that it applies to all public information and communications operators authorized to provide public
information and communications networks and
services in The Gambia.
Applicability of
licence conditions
31. (1) The holders of authorisations shall have a
set of basic rights and obligations, and those rights
and obligations shall be applicable to all operators
or service providers holding an authorisation, but,
the ability of authorized entities to avail themselves
of those rights may be conditional on their being
able to meet physical or technical requirements.
(2) Certain conditions shall be applicable only if the
licensee has a significant market power further to
a decision taken by the Authority as provided for by
this Act, and where the Authority intends to make a
finding of dominance, statutory consultation
