10. In the absence of an adequacy decision pursuant to Article
45(3) of the Regulation, the Minister may, following consultation
with the Commissioner, by regulations set limits to the transfer of
specific categories of personal data to a third country or an
international organisation for important reasons of public interest.

PART V
The Information and Data Protection Commissioner
11. (1) There shall be an Information and Data Protection
Commissioner, who shall be appointed by the Prime Minister after he
has consulted with the Leader of the Opposition, to perform the duties
of supervisory authority for the purposes of Chapter VI of the
Regulation.
(2) The Commissioner shall be responsible for monitoring and
enforcing the application of the provisions of this Act and the
Regulation, in order to protect the fundamental rights and freedoms of
natural persons in relation to processing of personal data and to
facilitate the free flow of personal data between Malta and any other
Member State.
