Version as at 6 December 2023 Privacy Act 2020 Part 1 s 7 (a) being a commercial operation; or (b) having a place of business in New Zealand; or (c) receiving any monetary payment for the supply of goods or services; or (d) intending to make a profit from its business in New Zealand. (4) Subpart 3 of Part 7 also applies to a court in relation to its judicial functions. (5) Section 212 applies to— 5 (a) a New Zealand agency: (b) an overseas agency: (c) an individual who is present in New Zealand: (d) a person who is outside New Zealand if— (i) any act or omission forming part of any offence under section 212 occurs in New Zealand; or (ii) any event necessary to the completion of any offence under sec‐ tion 212 occurs in New Zealand. Transitional, savings, and related provisions The transitional, savings, and related provisions set out in Schedule 1 have effect according to their terms. 6 Act binds the Crown This Act binds the Crown. Compare: 1993 No 28 s 5 Subpart 2—Interpretation and related matters 7 Interpretation (1) In this Act, unless the context otherwise requires,— action includes failure to act, and also includes any policy or practice agency means a person described in section 4 to whom this Act applies binding scheme means an internationally recognised scheme in which the par‐ ticipants agree to be bound by— (a) specified measures for protecting personal information that is collected, held, used, and disclosed; and (b) mechanisms for enforcing compliance with those measures Chairperson means the Chairperson of the Human Rights Review Tribunal, and includes a Deputy Chairperson of the Tribunal code of practice means a code of practice issued by the Commissioner under section 32 11
