is able to resume his office; and where both the Chairman and Vice-Chairman are unable
to perform their functions and duties, the Government may direct a Commissioner to
temporarily act as the Chairman.
15.
Meetings of Commission.- (1) The Commission may, subject to the provisions
of this Act, adopt general or specific resolutions in respect of the place, time and
procedure of its meetings and all the meetings of the Commission shall be held in
accordance with such resolutions :
Provided that until such resolutions are adopted or if no resolution has been
adopted on a specific matter, the meetings of the Commission shall be held in
accordance with the decision of the Chairman.
(2)
The presence of three Commissioners including the Chairman or, as the
case may be, the Vice-Chairman, shall constitute quorum for a meeting of the
Commission.
(4)
The Chairman and in his absence the Vice-Chairman shall preside over all
meetings of the Commission.
(5)
A decision of the Commission shall be taken in accordance with the
majority votes of the Commissioners present in the meeting, and in case of equality of
votes, the person presiding shall have a second or casting vote.
(6)
Any two Commissioners may, in writing, request the Chairman to call a
meeting of the Commissioners for the purpose of holding discussion or taking decision
on a specific issue, and within 7 (seven) days of receipt of such request the Chairman
shall call a meeting.
(7)
The Chairman may, for the purpose of presenting opinion, deliberation,
information or explanation on any issue, invite any relevant person and, subject to the
decision of the meeting, the opinion, deliberation, information or explanation of the
person so invited may be recorded in the proceedings of the meeting.
16.
Committee.- The Commission may, for the purpose of assisting it in the
performance of its functions, appoint necessary committees consisting of one or more
Commissioners, or any officer or employee of the Commission or any other person.
