[[Any person who has sexual intercourse or other sexual relations with a person
without his or her consent shall be guilty of rape and shall be imprisoned for a
minimum of 1 year and a maximum of 16 years. Consent is considered to have
been given if it is freely stated. Consent is not considered to have been given if
violence, threats or other forms of unlawful coercion are employed. ‘Violence’ here
includes deprivation of freedom of action by means of confinement, drugs or other

[The use of deception, or the exploitation of a person’s misconception regarding
