[The party’s case may be reopened if, before the end of the suspension period, a police investigation is initiated in which he or she is suspected of having committed a new offence during the suspension period or prior to the suspension, and also if he or she violates, in substantial aspects, the conditions imposed.] When [an investigator] considers that an indictment may be deferred under this Article, he or she shall refer the matter to the [prosecutor] with his or her proposals.
