-5Money-laundering 22. Any person conducting a money-laundering operation by facilitating, transferring, distributing or recycling money through a site on an information network, computer hardware or similar in order to obtain for it a legal character with the knowledge that it is derived from an unlawful source shall be liable to a prison sentence not exceeding ten years or a fine or both penalties. Chapter seven General provisions Incitement, agreement or complicity 23. (1) Any person who incites, aids, agrees to or participates with others in the commission of one of the offences provided for in this Act shall be considered to have committed the offence of incitement, even if [the offence] has not been committed, and shall be liable to half the penalty prescribed for it. (2) If the offence has been committed as a result of that incitement, the inciter shall be liable to the same penalty as that prescribed for the offence itself. Instigation 24. Any person who has instigated the commission of one of the offences provided for in this Act shall be considered to have committed the offence of instigation and shall be liable to the penalty prescribed for it. Confiscation 25. Without prejudice to the rights of bona fide third parties, the court shall in all cases order the confiscation of hardware, software or media used in the commission of any of the offences provided for in this Act and of the funds proceeding from them. The court shall also close the premises or enterprise in which any of the offences provided for in this Act have been committed, if the offence was committed with the knowledge of their owner, and shall do so for the period that it deems appropriate. Deportation of foreigners 26. In addition to any penalties provided for in this Act or any other act and bearing in mind the provisions of international treaties, the court shall, where the offences provided for in articles 7, 15, 16, 18, 20, 21 and 22 have been committed, order deportation if the convicted person is a foreigner. Chapter eight Law enforcement procedures Publication of rules 27. Without prejudice to the Criminal Procedures Act of 1991, the Chief Justice shall issue special rules determining the procedures to be followed in the prosecution of the offences provided for in this Act. Special court 28. The Chief Justice shall, in accordance with the Judiciary Act 1986, establish a special court for the offences provided for in this Act.
