regulations, prescribe fees and levies set out in sections 19, 20, 21, 39(8), 51
and 57(3).
(2)
Fees and levies prescribed under this section shall be
set in an open, transparent, non-discriminatory, objective
and competitively neutral manner, which may include
adjustment of such fees and levies to encourage and
accommodate the needs of small businesses in Solomon
Islands.
(3)
Fees and levies levied under this Act shall—
(a)
be evidenced by a certificate signed by the

constitute a debt due to the
Telecommunications Commission and may be
recovered in court.

In any proceeding to recover such debt the certificate
referred to in subsection (3) shall be prima facie evidence of
the existence and amount of such debt.
19,
(1)
The Telecommunications Commission may prescribe
administrative fees payable to cover its costs of processing—
(a)
Administration fees
applications and registrations for service and
frequency licences, including applications for
renewal of licences; and
(b)
the lodgement and consideration of any
application for a determination, order or
direction or of a dispute under section 100 or
111.
(2)
Administrative fees prescribed under subsection (1)
shall as far as practicable be within a range properly
chargeable for the costs of processing the matters referred to
in that subsection and shall not be unreasonable.
20.
(1)
The Telecommunications Commission may prescribe
an annual licence fee payable by licensed service providers as a percentage
of their gross revenues in their most recent financial reporting year.
(2)
The annual licence fee for any given financial year
shall not exceed two percent (the “percentage cap”) of a
service provider’s gross revenue for such financial year.
