Schedule 2 Amendments relating to Mutual Assistance Part 1 Stored communications 5EA Serious foreign contraventions For the purposes of this Act, a serious foreign contravention is a contravention of a law of a foreign country that is punishable by a maximum penalty of: (a) imprisonment for 3 years or more, imprisonment for life or the death penalty; or (b) a fine of an amount that is at least equivalent to 900 penalty units. 8 Paragraph 6H(c) Omit “paragraph 116(1)(d)”, substitute “subparagraph 116(1)(d)(i) or (ii), as the case requires”. 9 Paragraph 116(1)(d) Omit all the words after “with”, substitute: : (i) in the case of an application other than a mutual assistance application—the investigation by the agency of a serious contravention in which the person is involved (including as a victim of the serious contravention); or (ii) in the case of a mutual assistance application—the investigation or investigative proceeding, by the foreign country to which the application relates, of a serious foreign contravention to which the application relates and in which the person is involved (including as a victim of the serious foreign contravention); and 10 Paragraph 116(1)(e) After “subsection (2)”, insert “or (2A) (as the case requires)”. 11 Subsection 116(2) Omit ��The matters”, substitute “In the case of an application other than a mutual assistance application, the matters”. 12 Paragraph 116(2)(c) Omit “paragraph (1)(d)”, substitute “subparagraph (1)(d)(i)”. 13 After subsection 116(2) Insert: 24 Cybercrime Legislation Amendment Act 2012 No. 120, 2012 ComLaw Authoritative Act C2012A00120
