appropriate sanctions for non-compliance. Each State Party shall also consider
taking such measures as may be necessary to permit its competent authorities to
share that information with the competent authorities in other States Parties
when necessary to investigate and recover proceeds of crimes established in
accordance with this Convention.
[Article 31. Measures for direct recovery of property
1.
Each State Party shall, in accordance with its domestic legislation adopt
such legislative or other measures as may be necessary
(a) to permit another State Party, its citizens and stateless persons
permanently residing in its territory, legal persons established or having
permanent representation in its territory to initiate civil action in the courts of
that State Party to establish the right of property acquired through the
commission of an offence or other unlawful acts established in accordance with
this Convention;
(b)
to permit its courts to order to pay compensation or damages
resulting from such offences or other unlawful acts established in accordance
with this Convention; and
(c)
to permit its courts or competent authorities, when having to decide
on confiscation, to recognize claims of another State Party, its citizens and
stateless persons permanently residing in its territory, legal persons established
or having permanent representation in its territory as a legitimate owner of
property acquired through the commission of an offence established in
accordance with this Convention. ]
Article 32. Mechanisms for recovery of property through international
cooperation in the sphere of confiscation
1.
Each State Party, in order to provide mutual legal assistance with respect
to property acquired through the commission of an offence established in
accordance with this Convention, or means used when committing such
offences, shall, in accordance with its domestic legislation:
