(8) Any modification referred to in subsection (7) is unauthorized
if—
(a) the person whose act causes it is not himself entitled to
determine whether the modification should be made; and
(b) he does not have consent to the modification from any
person who is so entitled.
(9) A reference in this Act to a program includes a reference
to part of a program.
(10) A reference in this Act to a computer includes a reference
to a computer network.
PART II
OFFENCES
Unauthorized access to computer material
3. (1) A person shall be guilty of an offence if—
(a) he causes a computer to perform any function with intent
to secure access to any program or data held in any
computer;
(b) the access he intends to secure is unauthorized; and
(c) he knows at the time when he causes the computer to
perform the function that is the case.
(2) The intent a person has to have to commit an offence under
this section need not be directed at—
(a) any particular program or data;
(b) a program or data of any particular kind; or
(c) a program or data held in any particular computer.
(3) A person guilty of an offence under this section shall on
conviction be liable to a fine not exceeding fifty thousand ringgit
or to imprisonment for a term not exceeding five years or to both.
