Chapter 3 – On offences against life and health
Section 1
A person who takes the life of
another person is guilty of
murder and is sentenced to
imprisonment for a fixed term of
at least ten and at most eighteen
years, or for life. As grounds for
life imprisonment, particular
consideration is given to
whether the act was preceded by
careful
planning,

characterised
by
particular
cunning, aimed to promote or
conceal other offences, involved
severe suffering for the victim or
was
otherwise
particularly
ruthless. Act 2019:805.
1§
Den som berövar annan livet,
döms för mord till fängelse på
viss tid, lägst tio och högst arton
år, eller på livstid. Som skäl för
livstids fängelse ska det särskilt
beaktas om gärningen föregåtts
av noggrann planering, präglats
av särskild förslagenhet, syftat
till att främja eller dölja annan
brottslighet, inneburit svårt
lidande för offret eller annars
varit särskilt hänsynslös. Lag
(2019:805).
Section 2
If,
in
view
of
the
circumstances that occasioned
the act or for some other reason,
an offence referred to in Section
1 is considered less serious, the
person is guilty of manslaughter
2§
Är brott som i 1 § sägs med
hänsyn till de omständigheter
som föranlett gärningen eller
eljest att anse som mindre grovt,
dömes för dråp till fängelse, lägst
